Counter-notification
If you believe that material you posted or that was removed is not infringing, or that you have authorization to use it, you may send a counter-notification to the same address. A valid counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Product Guidebook may be found), and that you will accept service of process from the party who filed the original notice or its agent.
Repeat infringers
In appropriate circumstances, Product Guidebook will remove material and restrict access for users who are determined to be repeat infringers.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages.
